Madison and the Origins of Judicial Review," written by Kelly Darr for an introductory history course on U.S. civilization to 1977. The assignment called on students to write an essay "of no more than six pages focusing on a controversial issue related to the First Amendment." Darr chose to review the 1803 Marbury v. Madison decision and to relate that decision to the growth of the Supreme Court's powers. We've included the first four paragraphs of her essay, excerpted, and her endnotes and bibliography, which follow Chicago style.
